These Terms and Conditions ("Agreement") govern the use of the AI Receptionist service provided by Julian Kundu ("Service Provider", "we", "our", or "us") to the subscribing business ("Client", "you", or "your").

By subscribing to the AI Receptionist service, you agree to the following terms:

1. Service Description

The AI Receptionist is a virtual assistant powered by artificial intelligence. Some of its capabilities include:

• Answering frequently asked customer questions using business-specific information
• Booking appointments automatically through Calendly or sending customers SMS links to book themselves
• Capturing and storing contact details from inbound callers
• Operating 24/7, including after hours, weekends, and holidays

The assistant is customized based on your website content and any additional information you provide.

2. Onboarding Requirements

Before activation, you must:

• Attend a Zoom setup call with the Service Provider
• Complete the AI Receptionist customization form in full, as it contains all necessary details for accurate configuration

Service setup will not begin until this information is provided.

3. Subscription & Payment

• The AI Receptionist is available via monthly or yearly subscription.
• Plans include: Starter, Pro, Growth, and Agency, as well as an option for a custom enterprise solution
• Pricing is based on the number of AI call time minutes you require each month. Larger businesses may need more minutes, resulting in a higher plan tier.
• Payments are handled securely via PayPal.
• Subscriptions can be cancelled at any time. You will be billed at the start of each billing cycle. All payments are final and non-refundable.

4. Usage & Limitations

• Your usage is limited to the plan you select. If your call volume exceeds your plan's capacity, (e.g. the plan's call time minutes surpassed) you will be billed for the extra minutes. Additional charges for exceeded minutes vary depending on your selected plan.
• Appointment bookings are handled via your integrated Calendly account - you will be provided with login credentials. Appointment bookings are also possible through an SMS confirmation sent to the caller containing the link to your personal calendar.
• Performance may be affected if limits are consistently exceeded without upgrading.

5. Cancellation & Refunds

• You may cancel at any time.
• No refunds are provided for the current billing period (monthly or annually).
• Should you choose to cancel, our services will remain active to you until the end of your billing cycle. If you prefer to have them deleted, you may let us know via email.

6. Data & Privacy

• The AI accesses public information from your website and any content you provide.
• All data collected (e.g. caller names, contact info) is stored securely through Calendly or other designated tools.
• You are responsible for managing this data appropriately according to your local regulations.

7. Support & Maintenance

• Ongoing support is available via email: j.aireceptionists@gmail.com
• We will assist with setup, updates, and minor modifications as needed. All plans come with unlimited free revisions.

8. Intellectual Property

• The AI flows, setup structure, and related assets remain the intellectual property of the Service Provider.
• You may not duplicate, resell, or redistribute the service in any form.

9. Termination

• The Service Provider reserves the right to terminate service if the AI is used inappropriately or these terms are violated.
• Inappropriate use includes but is not limited to spam-like behavior, misleading representation, or abuse of system resources.

10. Limitation of Liability

• We are not liable for missed customer interactions, technical issues, or incorrect data collection.
• The service is offered "as is" and may be updated over time to improve performance.

11. Changes to These Terms

These terms may be updated. You will be notified via email of any major changes.
